The Federal High Court in Abuja on Monday adjourned a suit seeking to stop Senator Ireti Kingibe from presenting herself as a member of the African Democratic Congress (ADC) until June 9 for hearing.
Justice Peter Lifu fixed the date after counsel to the plaintiffs, I. G. Ogugwa, requested an adjournment.
Ogugwa told the court that the matter was not a pre-election case and prayed for a longer adjourned date when it was called.
The News Agency of Nigeria (NAN) reports that on April 2, Justice Lifu had declined to grant an ex parte application seeking an interim order restraining Senator Kingibe from parading herself as an ADC member.
Instead, the judge ordered that the lawmaker be put on notice to show cause why the reliefs sought should not be granted, and adjourned the matter to April 20 for hearing of all pending applications, including a preliminary objection filed by her counsel, Marshall Abubakar.
The suit was instituted by two executive members of the ADC in Wuse Ward, Abuja—Mr Okezuo Kanayo, the ward chairman, and Mr Isaiah Samuel, the secretary.
In their motion filed on March 17 through their counsel, Kolawole Olowookere, SAN, the plaintiffs asked the court for an interim injunction restraining Senator Kingibe from performing any duties or participating in activities reserved for ADC members pending the determination of the substantive suit.
They argued that the senator, despite being a sitting lawmaker representing the FCT, remains a member of the ADC and is subject to its constitution.
The plaintiffs further alleged that she was suspended by the Wuse Ward Executive Committee on March 10 over claims of anti-party activities, misconduct, and alleged seizure of party records.
According to them, the suspension followed due process under the party’s constitution and was approved by a two-thirds majority of the executive committee.
They also accused the senator of continuing to hold parallel meetings and issue statements as an ADC member, as well as allegedly using her security details to intimidate ward officials, a situation they said had caused tension within the ward.
