Tenure Elongation Ruling: Osun APC Heads To Appeal Court, Says LG Chairmen Will Remain In Council

The Osun State chapter of the All Progressives Congress has faulted Monday’s Federal High Court judgment over the tenure elongation suit by council chairmen elected under the party.
The APC said the court, in its ruling, affirmed the expiration of the tenure of its chairmen in October 2025.
The party, in a statement signed by its Director of Media and Information, Mogaji Kola Olabisi, however, said it will seek redress at a higher court.
Olabisi said a notice of appeal and a motion for stay of execution had already been filed, stressing that no enforcement process could be commenced against the APC chairmen until the appeal is determined.
He explained that the Court of Appeal in Abuja had earlier taken up appeals arising from interlocutory rulings in the case and adjourned the hearing to September 28, 2026.
With the appellate court already seized of the matter and a motion for stay of further proceedings pending, the party described the judgment delivered by Justice Adefunmilola A. Demi-Ajayi on June 15 as premature.

The APC also said the judgment rendered the local government election conducted by the Osun State Independent Electoral Commission on February 22, 2025, which produced council officials elected under the Peoples Democratic Party and their subsequent swearing-in on February 23 a nullity.
Olabisi argued that the purported poll and inauguration became invalid because the subsisting tenure of the APC chairmen and councillors was still running until October 2025.
The APC maintained that its chairmen and councillors, elected on October 15, 2022, would continue to discharge their constitutional duties pending the outcome of the appeal.
