Atiku Raises Alarm Over El-Rufai’s Continued Detention, Says Bail Must Not Become Punishment

Former Vice President, Alhaji Atiku Abubakar, has expressed concern over the continued detention of former Kaduna State Governor, Nasir El-Rufai, following the refusal of the Federal High Court to review what he described as difficult bail conditions.

In a statement issued on Wednesday by his Senior Special Assistant on Public Communication, Phrank Shaibu, Atiku said the development raises concerns about constitutional liberties, the administration of justice, and public confidence in the rule of law.

According to the former vice president, while courts have the discretion to impose bail conditions, such powers should be exercised fairly and reasonably, stressing that conditions that are excessively difficult to meet could defeat the purpose of granting bail.

Atiku maintained that the principle of presumption of innocence remains a cornerstone of Nigeria’s justice system, noting that bail was established to protect the liberty of accused persons pending the determination of their cases.

He argued that the implications of the case extend beyond El-Rufai, saying every citizen has a stake in ensuring that constitutional safeguards, including the right to liberty and fair hearing, are upheld.

The former presidential candidate also stressed the need for the judiciary to maintain public trust by ensuring that justice is not only done but is seen to be accessible and impartial.

Atiku further cautioned against situations where bail conditions effectively result in prolonged detention, describing such circumstances as a constructive denial of bail.

He called on all institutions involved in the administration of justice to uphold fairness, proportionality, and respect for fundamental rights, insisting that Nigeria’s democracy is strengthened when justice remains independent, accessible, and free from political considerations.
