The Osun State Government has instituted a legal action against the Inspector-General of Police, Kayode Egbetokun, and the state Commissioner of Police over alleged threats to life and incitement to violence attributed to Senator Francis Fadahunsi.
Filed at the Osun State High Court in Osogbo on Wednesday by the state Attorney-General and Commissioner for Justice, Oluwole Jimi-Bada, the suit seeks an order compelling the police to investigate the senator’s controversial remarks concerning members and supporters of the Accord Party.
Fadahunsi, who represents Osun East Senatorial District, was listed in the suit as a “person affected/interested party.”
The legal action followed a video purportedly showing the senator addressing supporters of the All Progressives Congress during a political gathering in which he allegedly instructed them to kill members of the Accord Party if they encountered them during the electoral process.
“From now on, whenever you see Accord members, kill them. I authorise you to kill them,” Fadahunsi was quoted as saying.
The senator subsequently explained that his statement was metaphorical, insisting that he was urging his supporters to defeat the Accord Party at the ballot box through lawful and peaceful means.
Following the controversy, the police invited Fadahunsi in a letter dated August 11, 2026, to clarify the circumstances surrounding the statements allegedly made during an APC campaign in Ilesa.
He honoured the invitation and was subsequently granted administrative bail.
However, the state government, through the suit, is asking the court to compel the police to conduct a comprehensive investigation into the video and the circumstances surrounding the alleged remarks.
Among other reliefs, the Attorney-General wants the police to obtain, preserve, authenticate and forensically examine the complete and unedited version of the video allegedly containing the senator’s remarks.
The government also wants the police to investigate the location, date, audience, sponsors, publishers and circulators of the recording, as well as all persons connected with the statements.
It further asked the court to compel the police to investigate the alleged instruction to APC supporters to kill Accord members, their wives and children, chase them from hotels and prevent them from participating freely in the election.
According to the suit, the alleged remarks could constitute “a clear and present danger of public incitement to violence, threats to life, threats to public peace, electoral violence, political intimidation, and threats to the free exercise of the electoral rights of citizens of Osun State.”
The state government is also seeking an order directing the police to take immediate preventive security measures to protect Accord Party members, supporters, candidates, agents and officials, as well as voters and other residents who may be endangered or intimidated by the alleged statements.
It further seeks an investigation into the potential criminal implications of the senator’s remarks under the Criminal Law of Osun State and other relevant statutes.
“AN ORDER OF MANDAMUS compelling the Respondents, jointly and severally, to immediately obtain, secure, preserve, authenticate, and forensically examine the complete and unedited version of the said video recording/publication and to meticulously investigate the circumstances surrounding its creation and dissemination, including but not limited to the location, date, audience, sponsors, publishers, circulators, and all persons connected with the statements allegedly contained therein, ensuring the integrity and chain of custody of all evidence,” part of the suit reads.
“AN ORDER OF MANDAMUS compelling the Respondents, jointly and severally, to immediately and comprehensively investigate the alleged statements credited to Senator Francis Adenigba Fadahunsi to the effect that members of the All Progressives Congress (APC) should kill Accord Party members anywhere they see them; kill their wives and children; chase them from hotels; and treat them as persons who are not normal human beings because they wear yellow caps, and to determine the full extent of their potential criminal implications under the Criminal Law of Osun State and other relevant statutes.
“AN ORDER OF MANDAMUS compelling the Respondents, jointly and severally, to immediately take all necessary lawful and preventive security measures to protect members, supporters, candidates, agents, and officials of Accord Party, as well as voters and other residents of Osun State who may reasonably be endangered or intimidated by the alleged incitement, threat, or public provocation arising from the said statements/publication, ensuring their safety and the peaceful exercise of their fundamental rights.”
