Man Arraigned For Allegedly Producing Adulterated Herbal Drinks In Osogbo

A 49-year-old man, Segun Benjamin, was on Thursday arraigned before a Chief Magistrate Court sitting in Osogbo for allegedly producing adulterated drinks unfit for human consumption.

Benjamin who was arraigned on three counts of felony before Chief Magistrate Dr Olusegun Ayilara, pleaded not guilty to the charges.

Police prosecutor, Inspector Temitope Fatoba, told the court that the defendant was found in possession of various adulterated products, including Bright Life Herbal Tonic, Kaye Bitters, Bright Life Herbal Teas, Atura Herbal Balm and Dr Fresh Super Bleach.

According to the charge sheet obtained by NAIJAONPOINT, the offences were allegedly committed on or before July 20, 2026, at about 9:30am on Odo-Ola Street, Igbona area, Osogbo.

Count  I reads: “That you, Benjamin Segun Bright ‘M’ and others now at large, on or before the 20th day of July 2026, at about 9:30am at Odo-Ola Street, Igbona area, Osogbo, in the Osogbo Magisterial District, did conspire among yourselves to commit felony, to wit: exposing for sale things unfit for food or drink, being in possession of adulterated/counterfeit products and thereby committed an offence contrary to and punishable under Section 517 of the Criminal Code Cap 34 Vol. II Laws of Osun State, 2002.”

Count II states that the defendant was in possession of various adulterated teas and drinks with intent to sell them as food or drink, which were unfit for human consumption and noxious, contrary to Section 243(1) of the Criminal Code.

The third count accuses him of unlawfully adulterating various teas and drinks intended for sale as food or drink, knowing they were likely to be sold as such, contrary to Section 243(2) of the Criminal Code.

The defence counsel, Barrister K.E. Ngwoke, who moved an oral bail application on behalf of the defendant, urged the court to grant his client bail.

Ruling on the bail application, Dr Ayilara granted the defendant bail in the sum of N5 million with two sureties.

The magistrate ordered that one surety must be a house owner with valid identification and must deposit title documents, while the other must be a responsible person with three-year tax clearance and a verifiable address.

The case was adjourned to November 30, 2026, for hearing.

NAIJAONPOINT gathered that the defendant was unable to perfect his bail and was subsequently taken to Ilesa Correctional Centre.
