Surrogate McKenna West Sued By Father Of Her Biological Child As War Rages With Couple Whose Baby She Refused To Abort
McKenna West is facing another legal dispute over a child, this time involving her own biological son.
While West remains wrapped up in a court battle concerning the baby she recently delivered as a surrogate, Robert Gross, the father of her biological child, has taken legal action against her in Alaska.

West is now dealing with a legal challenge involving Cassius, the biological son she shares with Gross. According to TMZ, court documents show that Gross filed a case against West in Alaska on September 2.
Gross stated in the filing that he and West have never been married but share Cassius, who was born in 2021. His legal action comes while West is already involved in a separate legal fight regarding the baby she recently delivered as a surrogate.
The latest case centers on how decisions concerning Cassius should be handled and what role each parent should have in his life.
Gross has asked the court to significantly limit West’s authority and access to their son, making the filing another major custody issue for her.
McKenna West Was Accused Of Not Being Mentally Stable
Gross is seeking sole decision-making authority over Cassius. In his petition, he also raised concerns about West taking their son from Alaska to Texas, claiming she “fled to Texas to avoid legal troubles here.”
According to the filing, Gross claims West has not returned with Cassius. He further alleged that her recent actions demonstrate that she is not mentally stable enough to make decisions concerning their child.
Those allegations form the basis of Gross’ request to take control of major decisions involving their son.
His claims have not been established as fact by the court, but they have now become central to the custody dispute between the former couple.

Gross is not only asking for greater decision-making power. He also wants restrictions placed on West’s time with Cassius, requesting that any visits she has with their son be supervised.
The request follows his allegations about West’s move to Texas with the child and his concerns about her recent behavior.
According to TMZ, Gross specifically asked the court to allow West to see Cassius only under supervision.
If granted, the request would considerably change West’s access to her biological son while giving Gross sole authority over decisions concerning him.
McKenna West’s Refusal To Terminate A Surrogacy Baby Led To Serious Legal Fight
West’s dispute over her biological son comes amid a separate legal battle involving Nausheen Gilkar and Omar Ahmed, the biological parents of a baby she carried as their surrogate.
Per reports, the couple claimed their agreement required West to terminate the pregnancy if a reasonable medical anomaly was discovered and they requested it.
During a scan at 20 weeks, doctors discovered that the fetus had a rare heart defect that would require surgery shortly after birth. West refused to terminate the pregnancy and traveled to Texas. Explaining her decision, she wrote, “It is unthinkable to me to give birth to a precious, living, breathing baby boy and yet deny him the chance to survive.”
The biological parents subsequently began legal proceedings against West, alleging breach of contract and seeking at least $100,000 before the child was born. After his birth on August 12, the baby was diagnosed with hypoplastic left heart syndrome, a condition in which the left side of the heart is underdeveloped.
West maintained that her priority was ensuring the baby received medical care. “My plea, my only goal, is simple: Let’s commit to giving this baby the full treatment he needs to live,” she claimed, per the New York Post.
The dispute has since developed into a battle over the child she refused to abort.
Biological Mother Continues To Fight Hard For Her Baby In Court

The custody dispute became even more serious when the baby’s biological mother, Nausheen Gilkar, took the stand during a Dallas court hearing.
Fighting back tears, Gilkar accused West of attempting to take control of the child she shares with her husband, Omar Ahmed.
“She’s making us run from doctor to doctor, state to state. With our baby — she’s trying to take him,” Gilkar testified, per NYP.
The hearing concerned whether a temporary restraining order preventing West from seeing or making decisions for the child would remain in place.
But West has since denied trying to take the baby for herself, insisting that all she wants is to ensure the child receives the essential treatment and care he needs to survive
