Socialite and businessman Afolabi Kazeem Michael, popularly known as KC Luxury, has filed a fundamental rights enforcement suit against the National Drug Law Enforcement Agency, NDLEA, seeking ₦190 million in damages over his continued detention.
KC Luxury is asking the Federal High Court in Lagos to declare his arrest and detention unlawful, alleging violations of his rights to personal liberty and privacy.
He was arrested by NDLEA operatives on August 13, 2026, at the Murtala Muhammed International Airport in Lagos while preparing to travel to Paris.
The NDLEA had linked his arrest to an investigation into the seizure of 184.50kg of cocaine allegedly connected to an international drug trafficking network using Nigeria as a transit point for shipments to the United Kingdom, Europe and Asia.
However, KC Luxury, through his lawyer, Abdulakeem Labi-Lawal (SAN), is challenging his continued detention without being formally charged with any criminal offence.
In an affidavit sworn by his father, Eric Afolabi, the family alleged that the businessman had spent 14 days in NDLEA custody without being informed of the specific offence for which he was being held or formally charged before a court.
The suit also accused the agency of invading his privacy and allegedly circulating photographs and videos of him while he was in custody.
The family further alleged that NDLEA operatives searched KC Luxury’s residence at Movamo Court, Banana Island, Lagos, without producing a search warrant.
According to the affidavit, no incriminating material was found during the search.
KC Luxury is seeking an order for his immediate release or bail on favourable terms pending the filing of any criminal charges against him.
Justice Friday Ogazi declined to grant the application ex parte and instead directed that the NDLEA be served with the case and given an opportunity to respond.
The judge also ordered the agency to produce KC Luxury in court at the next hearing, serve the relevant documents within four working days and file its response within five days of service.
The case was adjourned until September 9, 2026, for the hearing of the substantive application.
